The following terms of service are designed to provide the highest level of service available.
WHO WE ARE?
This XeonBD Terms Of Service agreement (hereafter referred to as the “TOS”) lays down the terms and conditions by which XeonBD’s Services (hereafter referred to as the “Services”) will be provided to you upon registration. You certify that you are at least 18 years of age. The TOS also describes prohibited uses of the Services. This TOS is not exhaustive and XeonBD reserves the right to modify it from time to time, effective when notification is posted at www.xeonbd.com. No verbal or written agreement/statement by any XeonBD employee or at XeonBD’s website will take precedence over the TOS. On registering for and using any Services provided by XeonBD, you the Customer agree to all the terms and conditions of the TOS, as modified from time to time, in its entirety. If Customer resells/represent the Services he or she is paying for, the Customer will be responsible for his or her Clients. XeonBD only recognizes the Customer who is paying for the Services and not his or her clients. Violation of the TOS or any such action that XeonBD deems inappropriate may result in the termination or suspension of the Services for the Customer.
1) NEW ACCOUNTS
We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) in case of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under. If there is ever an abuse issue or we need to contact you, the primary email address on file will be used for this purpose. It is your responsibility to ensure the email address on file is current or up to date at all times.
If you have a domain name registered with XeonBD, it is your responsibility to ensure that the contact information for your domain account and your actual domain name(s) is correct and up-to-date. XeonBD is not responsible for a lapsed registration due to outdated contact information being associated with the domain. If you need to verify or change this information, you should login to your clients area and change them by your self. Providing false contact information of any kind may result in the termination of your account.
For any kind of service purchase from XeonBD, it will be necessary to provide government issued identification (Passport/National ID/Driving License etc.), proof of your address (Utility Bill) within 3 days after establishing your account with XeonBD and this will strictly follow from April 12, 2010. If you fail to meet these requirements, the order may be considered fraudulent in nature and be denied.
Due to unforeseen complications with various mail servers and any connection problems between your ISP and XeonBD’s operation office, new account setup process may sometimes be delayed.
2) TRANSFERS
Our migration team will make every effort to help you move your site to us. However, transfers are provided as a best effort service by our migration team, and we can not make guarantees regarding the availability, possibility, or time required to complete an account transfer. Each hosting company is configured differently, and some hosting platforms save data in an incompatible or proprietary format, which may make it extremely difficult if not impossible to migrate some or all account data. We will try our best, but in some cases, we may be unable to assist you in a transfer of data from an old host. The free transfer services are available for 03 (three)days from your sign up date. Transfers outside of the 03 (three) day free period will incur a charge; for reseller/master reseller first twenty (20) end user account of his/her old host will transfer free of cost and for additional each account it’ll cost 300 BDT or 5 USD.
3) SATISFACTION GUARANTEED
30 Day Guarantee Statement valid only for Web Hosting service. If for any reason you are unhappy with the services you receive from XeonBD during the first 30 days of service (Only Web Hosting), you may request in writing via email or by our cancellation form (as mentioned below) that your services be discontinued at which time you will receive a full refund*. You must also state a detailed reason as to why you are canceling (as we request any cancellation, no matter the time frame). We are the sole arbiter as to if your reason is a valid reason and if all possible steps were taken on your side and on ours to correct the situation causing the interest to cancel. If client violated the terms and conditions and suspended in that case refund will not be offered also if He/She asked for cancellation and then agreed to continue using services can’t ask second time for refund.

4) PAYMENTS
When you subscribe to our services, you are subscribing to a pre-paid service and all the ITES (domain registration, web hosting, SSL, SiteLock etc.) services are subject to 5% VAT or for web development services are also subject to 5% VAT and 2% sales TAX.
All due payment invoice can be paid online using Aamarpay, SSLCommerz, bKash, PayPal and also through an offline method like Bank Transfer or Walk-in-Payment at our operation office. Except for any payment paid using our offline method, all online methods payments are subject to an additional payment gateway fee and it’ll be added automatically as you will choose the payment methods in your Clients Area > Invoice.
Renewal notices are sent several times via email from 30 to 1 days before the renewal date. We only accept Aamarpay, SSLCommerz, bKash, PayPal, Bank Transfer, Walk-in-Payment at our operation office for payment of services. In the event that your yearly charge is denied and we are unable to contact you, then the aforementioned late fees to enable your account shall apply. Please address any questions regarding payment to XeonBD sales from our clients’ area.
If a shared/reseller/VPS/Dedicated/Email Server/Spam Filtering/File Hosting etc. account has a past due invoice, we will perform the following actions.
1 Days – No Action Taken
2 Days – Accounts are suspended
7 Days – Late Fee Added
15 Days – Accounts will be terminated
5) CANCELLATIONS
If you wish to cancel your services, you must write to sales or request a Cancellation from your clients area.
6) OVERAGE CHARGES
Our service plans are designed to accommodate the majority of usage scenarios given the needs of our customers. However, your usage may vary and require additional allocations, specifically in the areas of storage and traffic. We will never charge your card automatically if your account requires more resources. You must keep your email address updated within your cPanel, so that you may receive an email when your account reaches certain limits determined solely by our system, ie. bandwidth exceeded warning at 80% at which time you may contact us to purchase a higher transfer quota for your account. If you do not contact us, the system will suspend your site if your allotments exceed.
7) REFUNDS/ACCOUNT TERMINATION
If for any reason, XeonBD fails to deliver said services, a prorated refund will be issued. No refunds will be issued if abuse of our stated policies forces XeonBD to suspend or terminate your services prematurely. In the event, you request account cancellation, once your service has been canceled your account will be suspended from use. It will then be deleted within 30 days. If for any other reason your account becomes suspended and remains suspended it will be deleted after a 10-day period. If a customer has more than one account under his name, XeonBD reserves the right to suspend all the account due to a non-payment of one or more accounts till all the payments are cleared.

8) CONTENT
All services provided by XeonBD. are to be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State, or Bangladesh Government’s local law is prohibited. This includes, but is not limited to copyrighted material, the material we judge to be threatening or obscene, material that jeopardizes national security, or material protected by trade secrets or other laws. The subscriber agrees to indemnify and hold harmless XeonBD, from any claims resulting from the subscriber’s use of XeonBD’s services which damages the subscriber or any other party.
XeonBD believes in freedom of speech; however, any content (written, visual, or implied) in the following areas will not be tolerated and is grounds for immediate suspension of service (in most cases customers will be allowed a zip file of their files): racism or prejudice due to color, creed, or belief; profanity or obscene language towards anyone but yourself; any violent/malicious content. We prefer that you self-govern your content and are responsible for what your website provides. We do not have the resources and time needed to govern our servers constantly which have growing and evolving content. However, if XeonBD is made aware of any questionable content on a XeonBD-hosted site, we will address the concerns directly with you and seek an amicable resolution. If anyone contacts us about content they have found on a XeonBD server/network that copyrights their own material or that they wish to be removed, we require legal documentation to take any further action.
We do not allow Web Proxy Services / Scripts or file hosting services or any type of adult content on our shared web hosting server or web hosting plans. No remote uploading/processing scripts usage like the rapid leech, Phpmusicsearch, Rapidshare premium link generator, etc are not allowed on our shared web hosting server. Torrent seeding using torrent flux or similar script may also cause a suspension in our network immediately. You are also not allowed to host an Image/Video Hosting site with us on our shared web hosting server or web hosting plans which takes lots of CPU resources and abuse the server memory, but such materials aren’t limited to our VPS/Dedicated Server plan. Although, we do not allow any kind of video streaming using FFMPEG or any format on the shared web hosting server, though if malicious material is found through a complaint from the abuse department, certain action will be taken in an urgent manner. But no video streaming matters are not limited on our VPS/dedicated server plans.
On shared web hosting service/server user only can host media files (mp3/music, image, video etc.) with the size under 20Mb which must needs to be linked to the HTML/Script files or for the need of the hosted website. But the media files ratio must not be more then 10% of the HTML/Script files. Any larger amount of media hosted on the shared web hosting service/server plan will be considered as abuse and will subject to immediate termination of that account without any notification. But no such restriction is placed for the VPS or Dedicated Server hosting plans.

Using any shared web hosting account provided by XeonBD as a backup/storage (files/database dump/file sharing media etc.) device is not permitted. XeonBD’s shared web hosting accounts are not to be used for the purposes of distributing and/or storing an unusual amount of files. A shared web hosting account is for website storage only not for a using it as remote file storage service or for hosting file storage application (eg. File Cloud, OwnCloud, NextCloud, RapidLeech etc). If we find any shared web hosting account involve with such activity, we will be considered as abuse of XeonBD’s TOS and is subject to immediate suspension/termination of the service. But backup/storage matters are not restricted on the VPS/Dedicated Server plans.
Any website whose disk space usage for storing the files exceed 70% of its total usage, either in terms of total size or number of files, will be deemed to be using an unusual amount of files. At that point, if we find that those files are illegal or harmful in any way, you will be notified. If you do not have any negative intentions such as causing harm to our server or to others with the files you keep, then you have nothing to worry about.
XeonBD services, including all related equipment, networks, and network devices are provided only for authorized customer use. XeonBD systems may be monitored for all lawful purposes, including to ensure that use is authorized, for management of the system, to facilitate protection against unauthorized access, and to verify security procedures, survivability, and operational security. During monitoring, information may be examined, recorded, copied and used for authorized purposes. Use of XeonBD system(s) constitutes consent to monitoring for these purposes.
Any account found connecting to a third party network or system without authorization from the third party is subject to suspension. Access to networks or systems outside of your direct control must be with expressed written consent from the third party. XeonBD may, at its discretion, request and require documentation to prove access to a third party network or system is authorized.
We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene, threatening, illegal, or violates our terms of service in any manner may be removed from our servers (or otherwise disabled), with or without notice.
Failure to respond to email from our abuse department within 48 hours may result in the suspension or termination of your services. All abuse issues must be dealt with via trouble ticket/email and will have a response within 48 hours.
If in doubt regarding the acceptability of your site or service, please contact us at abuse[at]xeonbd[dot]com and we will be happy to assist you.
Potential harm to minors is strictly forbidden, including but not limited to child pornography or content perceived to be child pornography: Any site found to host child pornography or linking to child pornography will be suspended immediately without notice.
Resellers: we will suspend the site in question and will notify you so you may terminate the account. We will further monitor your activity; more than one infraction of this type may result in the immediate termination of your account.
Direct customers: Your services will be terminated with or without notice.
Opt-in Email Marketing:
If you choose to engage in marketing your site and/or services via email please heed the following. The only permitted form of email marketing is that in which the list is accepted in. By definition, opt-in is where people provide you with their email address specifically requesting to be on your email list for information about your site and/or service. If we find your account transmitting email to persons that did not authorize such activity, that is grounds to suspend and terminate your site. Note: On the flip side, the joining of an opt-in email list does not guarantee the legitimacy of such a list. Please contact us before taking any steps so that you will not be a victim of spam from second and third parties of such lists.
9) ZERO TOLERANCE SPAM POLICY
XeonBD has a zero-tolerance policy regarding unsolicited commercial email (UCE) and unsolicited bulk email (UBE) also known as spam mail. The definition of spam: An electronic message is spam mail IF:
(1) the recipients personal identity and context are irrelevant because the message is equally applicable to many other potential recipients; AND(2) the recipient has not verifiably granted deliberate, explicit, and still-revocable permission for it to be sent; AND (3) the transmission and reception of the message appears to the recipient to give a disproportionate benefit to the sender.
You will be cited with UCE/UBE Abuse if you send an email to persons who have not specifically asked to receive the email from you. The sending origin of such email is irrelevant. Upon confirmation of abuse, any XeonBD customer engaging in this practice will have their service suspended. Not only does spam place a strain on the server that can negatively affect that servers uptime record and performance record, you subject that server to the possibility of being blacklisted.
If your site will be sending mailings out to subscribers, this is a checklist of what you are required to do:
10) SCRIPT USAGE POLICY
XeonBD provides our clients with Web Hosting accounts that permit the use of CGI files, PHP scripts, and other executable programs. Because these scripts use much more system resources than standard HTML pages, certain restrictions must be made governing the use of such “active content” systems. We regret that in many cases we are unable to determine what specific script or application is causing the system resource over-run. Under most circumstances, we are able to pin-point it to the offending account on the system. The following rules apply to all “active content” files as listed above:
NOTE: If a script will NOT execute with a permission other than 777 (rarely the case) you may contact customer care to get approval for the script which will be given under most circumstances.
Any accounts with scripts found in violation of these policies are subject to the future scrutiny of all CGI, Perl, CFM, ASP, and PHP scripts by our System Administrators. If a script is found to be harmful to the system, it will be killed immediately and the account locked down until the account owners have been contacted. Malicious scripts are subject to immediate account termination without refund of any pre-paid monies
Violations of the Terms of Service will waive the refund policy.
11) RESOURCE USAGE POLICY
11.a) Server Resource Abuse Policy (SRAP):
Any website on our shared servers that uses a high amount of server resources (CPU, memory usage, and network resources) will be given an option to pay for a dedicated server. The abuse and misuse of system resources is a serious problem, and XeonBD does not tolerate it. Accounts on a shared server must be shared with other users, so we must limit how much of the CPU and memory that can be used by anyone account.
In all fairness, we cannot allow one or two clients to use all of the system resources on a shared machine and have all other clients suffer because of it. Excessive CPU & memory usage by one or more clients causes extreme slowness in all areas: MySQL, Email, HTTP and more. If the CPU & memory usage by a few clients gets out of hand, all sites hosted on the machine will return errors and not be accessible in any way.
AVERAGE SERVER RESOURCE LIMITS
11.b) Illegal Usage :
XeonBD servers may be used for lawful purposes only. Transmission, storage, or distribution of any information, data or material in violation of any applicable law or regulation is prohibited. This includes, but is not limited to copyrighted material, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat or violates export control laws. Examples of non-acceptable content or links: Pirated software, Hackers programs or archives, Warez sites, MP3, and IRC bots. Any type of forum/discussion board discussing where to obtain such files or one that distributes the files is also prohibited. The subscriber to XeonBD service agrees to indemnify and hold harmless XeonBD from any claims resulting from the use of the service that damages the subscriber or any other party. XeonBD will be the sole arbiter as to what constitutes a violation of this provision.
11.c)Illegal Content:
XeonBD does not allow background Daemons such as IRC bots; eggdrop; BitchX; XiRCON; and any other program that interferes with normal server operation. No warez is allowed. Web proxies are not tolerated. This includes NPH-Proxy and web proxy. If your site is found to hold any proxy files, your account will be suspended and the account holder will be issued a fee of $50 USD. When using an account with shell, you are not allowed to run ANY servers or services on the XeonBD network. Servers are defined as perlbots, proxies, BitchX, psyBnc, root exploits, DDoS scripts, Shoutcast servers, etc. Running any of these will face an immediate suspension, and users will be subject to a fine no less than $50.00 USD, and no more than $100.00 USD. XeonBD reserves the right to terminate an account for these activities also.
11.d) Software Distribution:
XeonBD web hosting accounts are not to be used for the purposes of distributing software and multimedia products. If you wish to distribute software and/or multimedia files, please contact our sales for special arrangement.
11.e) Chat Rooms:
XeonBD does not provide nor allow chat rooms on shared hosting environment. You may elect for a dedicated server to run a chat room efficiently.
11.f) IRC:
XeonBD does not allow IRC or IRC bots to be operated on our shared or reseller servers. They are allowed on dedicated servers provided that no negative effects occur to our network.
11.g) Liabilities:
XeonBD, makes no endorsement, claims, or promises regarding the services offered by our customers and will not be held liable for any disputes or claims against said customers. In no event shall XeonBD be liable for any direct, indirect, incidental, consequential, special and exemplary damages, or any damages whatsoever, arising from the use or performance of this website or from any information, services or products provided through your website. We are not responsible for any content on any server in our network and will not take any action against any questionable material or action until the website in question is brought to our attention by emailing us.
12) IP ADDRESS OWNERSHIP
XeonBD shall maintain and control ownership of all IP numbers and addresses that may be assigned to you by XeonBD. XeonBD reserves the right to change or remove any and all such IP numbers and addresses.
13) SECURITY
Users are prohibited from violating or attempting to violate the security of the XeonBD Network. Violations of system or network security may result in civil or criminal liability. XeonBD will investigate occurrences, which may involve cooperation with law enforcement authorities in prosecuting Users who are involved in such violations. These violations include, without limitation:
1) Accessing data not intended for such user or logging into a server or account, which such user is not authorized to access,
2) Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization,
3) Attempting to interfere with service to any user, host or network, including, without limitation, via means of overloading, ping flooding, mail bombing,
4) Forging any TCP/IP packet header or any part of the header information in any e-mail or forum posting,
5) Taking any action in order to obtain services to which such User is not entitled,
6) Attempting to couple many hosting packages together to take advantage of massive space or bandwidth allocations
Each hosting package purchased is unique to a do main name and use – you are not allowed to purchase multiple plans to obtain combined bandwidth & space. XeonBD will stop such transactions and label them as deceptive. We have an upgrade path for all services and we can often times work out special deals for users if they ask us for the assistance.
Violations of system or network security are prohibited, and may result in criminal and civil liability. Examples include, but are not limited to the following: Unauthorized access, use, probe, or scan of a systems security or authentication measures, data or traffic. Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks. Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.
14) SERVER ABUSE
Any attempts to undermine or cause harm to a XeonBD Web server or subscriber of XeonBD Web is strictly prohibited including, but not limited to:
You will be held responsible for all actions performed by your account whether it be done by you or by others.
All sub-networks of XeonBD. and all dedicated servers must adhere to the above policies.
15) BANDWIDTH AND TRAFFIC MEASUREMENT AND OVERAGE FEES POLICY
As of January 11, 2020, all monthly traffic listings for Startup, Enterprise, Corporate, VPS, Dedicated Servers or any other hosting plans consist of the sum of incoming and outgoing traffic allowance. Incoming and outgoing traffic allowances are calculated on a 50/50 split of incoming to outgoing traffic based on the total allocated traffic, therefore the incoming and outgoing traffic allowances are each half of the total listed traffic. Any traffic usage exceeding either the incoming or outgoing traffic total will be billed at the rate describe at your plan while you purchased per MB/GB over.
XeonBD’s traffic usage policy is simple! You are allotted a portion of traffic per month to do with as you please. For shared hosting plans, if the amount of data transfer exceeds the user’s plan subscription, the account will be suspended but the user may receive warnings through an email, and you may be contacted by XeonBD/XeonBD staff for overuse and you may be given positive options.
For any shared bandwidth port (that offered mostly with VPS/Dedicated Server/FTP server plan) XeonBD will not provide any minimum bandwidth guaranty (either it’s international/IX) but user can have any amount of dedicated bandwidth port and for on dedicated bandwidth port upstream service provider will Provide 75% bandwidth guaranty up to upstream service provider’s Singapore/UK server/pop in case of International and 100% up to IX service provider’s port. The dedicated bandwidth port comes as an addon, for pricing offer for dedicated bandwidth port contact XeonBD’s sales team.
16) SCHEDULED MAINTENANCE AND DOWNTIME
XeonBD Web server will use its commercially reasonable efforts to provide services 24 hours a day, seven days a week. Subscriber acknowledges that from time to time the services may be inaccessible or inoperable for various reasons, including periodic maintenance procedures or upgrades (“Scheduled Downtime”); or service malfunctions, and causes beyond XeonBD Web’s control or which are not reasonably foreseeable by XeonBD Web, including the interruption or failure of telecommunications or digital transmission links, hostile network attacks, or network congestion or other failures. XeonBD Web will provide at least 48 hours advance notice to the subscriber for Scheduled Downtimes and will use commercially reasonable efforts to minimize any other disruption, inaccessibility and/or inoperability of its web servers. XeonBD Web has no responsibility for downtime resulting from a user’s actions. Also, the 99.99% network uptime guarantee does not apply for shared accounts.
17) RESPONSIBILITY (RESELLER/CLIENT)
The client is responsible for all activity originating from the account unless proven to be a victim of outside hacking or address forgery. The client is responsible for securing their username/password. The client assumes responsibility for all material on their site that may be put on by a third party (such as the usage of Free For All links pages). Use of XeonBD’s service requires a certain level of knowledge in the use of Internet languages, protocols, and software. This level of knowledge varies depending on the anticipated use and desired content of the web space by the client. The following examples are offered: Web Publishing: requires knowledge of HTML, properly locating and linking documents, FTPing Web contents, Graphics, text, sound, image mapping, etc. FrontPage web publishing: knowledge of the FrontPage tools as well as Telnet and FTP understanding and capability. CGI-Scripts: requires a knowledge of the UNIX environment, TAR & GUNZIP commands, Perl, CShell scripts, permissions, etc. Mail: a use of mail clients to receive and send mail, etc. The client agrees that he or she has the necessary knowledge to create and maintain their web space. Client agrees that it is not the responsibility of XeonBD to provide this knowledge or support outside matter specific to XeonBD servers.
18) BACKUPS
XeonBD takes extreme steps to maintain system integrity. However, XeonBD shall not be held responsible for the loss of data due to any cause. To ensure the highest level of data protection, XeonBD recommends that ALL information/data be backed up on their user’s computer time to time as per their need. As with any data that you hold a high importance to, it should be in more than one location at all times.
Only XeonBD’s shared web hosting server user is having automated complementary (no data consistency or guarantee is included) remote data backup (any account having more than 50 GB of data is not covered under the complementary remote data backup features) option available with no extra charge which is primarily designed for restoring the data from the last best backup if the shared web hosting server ever faces any hardware/service etc. failure, not for customer/users error.
Noted: VPS/VDS/Dedicated server user doesn’t have any data backup option includes by default. Nor even any backup of the VPS/VDS/Dedicated server customer’s data is stored on XeonBD’s side for any disaster recovery purpose. So, it’s always the customer’s responsibility to create their backup strategy.
But backup solutions can be provided/provisioned via the 3rd party vendor with additional pricing according to the 3rd party vendor’s terms/solutions.
19) ACTIONS
The failure by a customer to meet or follow any of the above policies/terms is grounds for account deactivation. XeonBD will be the sole arbiter as to what constitutes a violation of the AUP. XeonBD reserves the right to remove any account without prior notice.
When XeonBD becomes aware of an alleged violation of its AUP, XeonBD will initiate an investigation. During the investigation, XeonBD may restrict a customers access in order to prevent further potentially unauthorized activity. Depending on the severity of the violation, XeonBD may, at its sole discretion, restrict, suspend, or terminate a customers web hosting account and/or pursue other civil remedies. If such violation is a criminal offense, XeonBD will notify the appropriate law enforcement authorities of such violation.
XeonBD does not issue credits for outages incurred through service disablement resulting from AUP violations.
XeonBD customers agree to indemnify and hold harmless XeonBD from any claims resulting from the use of our services that damages them or any other party. The XeonBD service is provided on an as is, as available basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose or non-infringement. XeonBD expressly disclaims any representation or warranty that the XeonBD service will be error-free, secure or uninterrupted. No oral advice or written information given by XeonBD, its employees, licensors or the like, will create a warranty; nor may you rely on any such information or advice. XeonBD and its partners and suppliers will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of the service.
20) MODIFICATION
XeonBD reserves the right to add, delete, or modify any provision of this policy at any time without notice.
21) REFUSAL OF SERVICE
We reserve the right to refuse, cancel, or suspend service at our sole discretion. An example of the refusal of service is if an account continues to abuse our policies after warnings. Refusal, cancellation or suspension of services especially holds true to issues with spam or any script abuse. Another example of the refusal of service is if a customer becomes very unreasonable, unprofessional, extremely difficult to work with or threatening. Said customers account will be suspended and we will recommend to the customer to find a new host. A backup of the account(s) will be provided.
There are special exceptions to these rules to be determined at the time we discover abuse. There are different combinations of usage that can create problems and other special cases. At any given time a server is unstable and an account is found to be the cause, we reserve the right to suspend the account to keep the server online and operating normally. If the usage is an increasing trend, we recommend the user invest in a dedicated server so the website can grow at a normal rate without restriction.

১) নতুন অ্যাকাউন্ট
আপনার পেমেন্ট পাওয়ার পর এবং অর্ডার যাচাই করে আমরা আপনার অ্যাকাউন্ট চালু করব। আপনি এমন একটি ইমেইল ঠিকানা দেবেন, যা আপনার রেজিস্টার করা ডোমেইনের বাইরে। কোনো সমস্যা হলে বা আমাদের আপনার সঙ্গে যোগাযোগ করতে হলে, আপনার দেওয়া প্রাথমিক ইমেইল ঠিকানাই ব্যবহার করা হবে। তাই সবসময় ইমেইল ঠিকানা সঠিক ও আপডেট রাখা আপনার দায়িত্ব।
যদি আপনার ডোমেইন XeonBD থেকে নেওয়া হয়, তাহলে ডোমেইনের তথ্য আপডেট রাখা আপনার দায়িত্ব। ভুল বা পুরনো তথ্যের জন্য রেজিস্ট্রেশন বন্ধ হয়ে গেলে XeonBD দায়ী থাকবে না। আপনি ক্লায়েন্ট এরিয়ায় লগইন করে তথ্য ঠিক করতে পারবেন। ভুল বা মিথ্যা তথ্য দিলে আপনার অ্যাকাউন্ট বন্ধ হতে পারে।
XeonBD থেকে সেবা কিনতে হলে, সরকার প্রদত্ত পরিচয়পত্র (পাসপোর্ট, জাতীয় পরিচয়পত্র বা ড্রাইভিং লাইসেন্স) এবং ঠিকানার প্রমাণ (ইউটিলিটি বিল) দিতে হবে। এটি অ্যাকাউন্ট খোলার ৩ দিনের মধ্যে দিতে হবে। যদি আপনি এই শর্ত পূরণ না করেন, তাহলে আপনার অর্ডার বাতিল হতে পারে।
কখনো কখনো সার্ভার সমস্যা বা ইন্টারনেট সমস্যার কারণে নতুন অ্যাকাউন্ট চালু করতে দেরি হতে পারে।
২) ট্রান্সফার
আমাদের মাইগ্রেশন টিম আপনার সাইট আমাদের সার্ভারে আনার জন্য সর্বোচ্চ চেষ্টা করবে। তবে আমরা এটা গ্যারান্টি দিতে পারি না যে ট্রান্সফার সবসময় সম্ভব হবে, কত সময় লাগবে, বা এটি সফলভাবে শেষ করা যাবে।
প্রতিটি হোস্টিং কোম্পানির সেটআপ আলাদা। কিছু হোস্টিং প্ল্যাটফর্ম এমন ফরম্যাটে ডেটা সংরক্ষণ করে, যা আমাদের কাছে ট্রান্সফার করা কঠিন বা অসম্ভব হতে পারে। আমরা সর্বোচ্চ চেষ্টা করব, তবে সবসময় ট্রান্সফার সম্ভব নাও হতে পারে।

রিসেলার বা মাস্টার রিসেলারদের ক্ষেত্রে, পুরনো হোস্ট থেকে প্রথম ২০টি অ্যাকাউন্ট বিনামূল্যে ট্রান্সফার করা হবে। এর পর প্রতি অ্যাকাউন্টের জন্য ৩০০ টাকা (BDT) বা ৫ ডলার (USD) চার্জ করা হবে।
৩) সন্তুষ্টি নিশ্চিত
শুধুমাত্র ওয়েব হোস্টিং সেবার জন্য ৩০ দিনের গ্যারান্টি প্রযোজ্য। যদি আপনি XeonBD থেকে পাওয়া ওয়েব হোস্টিং সেবায় প্রথম ৩০ দিনের মধ্যে কোনো কারণে সন্তুষ্ট না হন, তাহলে আপনি ইমেইল বা আমাদের ক্যান্সলেশন ফর্ম (নিচে উল্লেখ করা আছে) ব্যবহার করে লিখিতভাবে সেবা বন্ধ করার অনুরোধ করতে পারবেন। এই ক্ষেত্রে আপনি সম্পূর্ণ টাকা ফেরত পাবেন*। তবে, কেন আপনি সেবা বন্ধ করতে চাইছেন তার একটি বিস্তারিত কারণ জানাতে হবে।
আমরা বিচার করব আপনার দেওয়া কারণটি যথার্থ কি না এবং সমস্যাটি সমাধান করার জন্য আপনার এবং আমাদের পক্ষ থেকে যথাসাধ্য চেষ্টা করা হয়েছে কি না। যদি গ্রাহক শর্ত ভঙ্গ করেন এবং তার অ্যাকাউন্ট স্থগিত করা হয়, তাহলে কোনো টাকা ফেরত দেওয়া হবে না।

আমাদের সেবাগুলি সাবস্ক্রাইব করার সময়, আপনি পূর্ব প্রদেয় পরিষেবা গ্রহণ করছেন। ডোমেইন রেজিস্ট্রেশন, ওয়েব হোস্টিং, SSL, SiteLock ইত্যাদির ক্ষেত্রে ৫% ভ্যাট এবং ওয়েব ডেভেলপমেন্ট সেবার জন্য ৫% ভ্যাট এবং ২% সেলস ট্যাক্স প্রযোজ্য।
পেমেন্ট পদ্ধতি:
আপনার পেমেন্ট অনলাইনে করতে পারবেন SSLCommerz, MFS-এর মাধ্যমে। এছাড়াও ব্যাংক ট্রান্সফার বা আমাদের অফিসে এসে পেমেন্ট করতে পারবেন। তবে অফলাইনে পেমেন্ট ব্যতীত অন্যান্য সব অনলাইন পেমেন্টে অতিরিক্ত পেমেন্ট গেটওয়ে ফি প্রযোজ্য হবে এবং এটি স্বয়ংক্রিয়ভাবে আপনার ক্লায়েন্ট এরিয়া > ইনভয়েস-এ যোগ হবে।

পেমেন্ট না হলে কী হবে:
যদি কোনও শেয়ার্ড/রিসেলার/VPS/ডেডিকেটেড/ইমেইল সার্ভার/স্প্যাম ফিল্টারিং/ফাইল হোস্টিং ইত্যাদি অ্যাকাউন্টের বিল বকেয়া থাকে:
৫) বাতিলকরণ (Cancellations)
যদি আপনি আপনার সেবা বাতিল করতে চান, তাহলে আপনাকে আমাদের সেলস টিমে লিখিতভাবে জানাতে হবে অথবা আপনার ক্লায়েন্ট এরিয়া থেকে বাতিলকরণের জন্য অনুরোধ করতে হবে।
৬) অতিরিক্ত চার্জ (Overage Charges)
আমাদের সেবা পরিকল্পনাগুলি গ্রাহকদের অধিকাংশ চাহিদা পূরণের জন্য তৈরি করা হয়েছে। তবে, আপনার ব্যবহারের পরিমাণ অনুযায়ী বাড়তি স্টোরেজ বা ট্রাফিক প্রয়োজন হতে পারে। আপনার অ্যাকাউন্টে অতিরিক্ত সম্পদ প্রয়োজন হলে আমরা স্বয়ংক্রিয়ভাবে আপনার কার্ড চার্জ করব না।
আপনার cPanel-এ ইমেইল ঠিকানা হালনাগাদ রাখুন, যাতে আপনার অ্যাকাউন্ট নির্দিষ্ট সীমা অতিক্রম করলে (যেমন: ব্যান্ডউইথ ৮০% পূর্ণ হলে) আপনি ইমেইল নোটিফিকেশন পান। এ সময় আপনি আমাদের সাথে যোগাযোগ করে আরও ব্যান্ডউইথ কিনতে পারেন। যদি যোগাযোগ না করেন, এবং আপনার সীমা অতিক্রম হয়, তবে আপনার সাইট সিস্টেম দ্বারা স্থগিত করা হবে।

১০) স্ক্রিপ্ট ব্যবহারের নীতি:
XeonBD আমাদের গ্রাহকদের এমন ওয়েব হোস্টিং অ্যাকাউন্ট প্রদান করে যেখানে CGI ফাইল, PHP স্ক্রিপ্ট, এবং অন্যান্য প্রোগ্রাম ব্যবহার করা যায়। তবে, এই ধরনের স্ক্রিপ্ট HTML পেজের চেয়ে অনেক বেশি সিস্টেম রিসোর্স ব্যবহার করে। তাই, স্ক্রিপ্ট ব্যবহারের ক্ষেত্রে নির্দিষ্ট কিছু নিয়মাবলী অনুসরণ করতে হবে। নিচে স্ক্রিপ্ট ব্যবহারের জন্য নির্ধারিত নিয়মাবলী উল্লেখ করা হলো:
উপরোক্ত নীতিগুলো মেনে চলা বাধ্যতামূলক। অন্যথায়, প্রয়োজনীয় ব্যবস্থা নেওয়া হবে।
গুরুত্বপূর্ণ নোট:
যদি কোনো স্ক্রিপ্ট ৭৭৭ ছাড়া অন্য কোনো অনুমতিতে কাজ না করে (এটি খুবই বিরল), তবে আপনি গ্রাহক সেবার সঙ্গে যোগাযোগ করতে পারেন। বেশিরভাগ ক্ষেত্রেই এই স্ক্রিপ্টের জন্য অনুমোদন দেওয়া হবে।
যদি কোনো অ্যাকাউন্টে এমন স্ক্রিপ্ট পাওয়া যায় যা এই নীতিমালা লঙ্ঘন করে, তবে আমাদের সিস্টেম অ্যাডমিনিস্ট্রেটররা ওই অ্যাকাউন্টের সমস্ত CGI, Perl, CFM, ASP, এবং PHP স্ক্রিপ্ট ভবিষ্যতে পরীক্ষা করবেন।
টার্মস অফ সার্ভিস লঙ্ঘন করলে রিফান্ড নীতিমালা প্রযোজ্য হবে না।
১১) রিসোর্স ব্যবহারের নীতিমালা
১১.এ) সার্ভার রিসোর্স অপব্যবহার নীতিমালা (SRAP):
যে কোনো ওয়েবসাইট যা শেয়ার্ড সার্ভারে উচ্চ পরিমাণে রিসোর্স (CPU, মেমোরি, নেটওয়ার্ক) ব্যবহার করে, তাদেরকে ডেডিকেটেড সার্ভারে আপগ্রেড করার প্রস্তাব দেওয়া হবে। শেয়ার্ড সার্ভারে রিসোর্স অপব্যবহার করা খুবই গুরুতর সমস্যা, যা XeonBD সহ্য করে না।
শেয়ার্ড সার্ভারে অনেক ব্যবহারকারী একসঙ্গে রিসোর্স ব্যবহার করেন। তাই, নির্দিষ্ট কিছু অ্যাকাউন্টের CPU এবং মেমোরি ব্যবহারের সীমা নির্ধারণ করা হয়েছে।
অন্য ব্যবহারকারীদের সমস্যা সৃষ্টি হয় এমন অতিরিক্ত CPU ও মেমোরি ব্যবহার করার অনুমতি দেওয়া হবে না। যদি একজন বা একাধিক ব্যবহারকারী অতিরিক্ত রিসোর্স ব্যবহার করেন, তাহলে পুরো সার্ভারে সমস্যা হতে পারে এবং ওয়েবসাইটগুলো ধীর হয়ে যাবে বা কাজ করবে না।
গড় সার্ভার রিসোর্স ব্যবহারের সীমা:

XeonBD-এর সার্ভার শুধুমাত্র বৈধ কাজে ব্যবহার করা যাবে। কোনো আইন বা বিধি লঙ্ঘন করে তথ্য, ডেটা, বা উপাদান প্রেরণ, সংরক্ষণ বা বিতরণ করা নিষিদ্ধ। এর মধ্যে অন্তর্ভুক্ত, তবে সীমাবদ্ধ নয়, কপিরাইটযুক্ত মেটেরিয়াল, ট্রেডমার্ক, ট্রেড সিক্রেট বা অন্য কোনো বুদ্ধিবৃত্তিক সম্পত্তি যা অনুমতি ছাড়া ব্যবহৃত হয়। এছাড়াও অশ্লীল, মানহানিকর, বেআইনি হুমকি প্রদানকারী, বা রপ্তানি নিয়ন্ত্রণ আইন লঙ্ঘনকারী উপাদানও নিষিদ্ধ।

শেয়ার্ড হোস্টিংয়ে কোনো চ্যাট রুম চালানো যাবে না। চ্যাট রুম পরিচালনার জন্য ডেডিকেটেড সার্ভার নিতে হবে।

শেয়ার্ড বা রিসেলার সার্ভারে IRC বা IRC বট চালানো নিষিদ্ধ। তবে ডেডিকেটেড সার্ভারে এটি অনুমোদিত, যদি এটি নেটওয়ার্কের কোনো ক্ষতি না করে।

XeonBD-এর সমস্ত আইপি নম্বর এবং ঠিকানার মালিকানা XeonBD-এর কাছে থাকবে। XeonBD প্রয়োজনে যে কোনো আইপি নম্বর বা ঠিকানা পরিবর্তন বা অপসারণের অধিকার রাখে।
১৩) নিরাপত্তা:
XeonBD নেটওয়ার্কের নিরাপত্তা লঙ্ঘন করা বা করার চেষ্টা করা কঠোরভাবে নিষিদ্ধ। এই ধরনের লঙ্ঘন আইনি শাস্তি এবং ক্ষতিপূরণের কারণ হতে পারে। XeonBD এমন ঘটনা তদন্ত করবে এবং প্রয়োজনে আইন প্রয়োগকারী কর্তৃপক্ষের সাথে সহযোগিতা করবে।

১৫) ব্যান্ডউইথ এবং ট্রাফিক পরিমাপ ও অতিরিক্ত ফি নীতিমালা:
১১ জানুয়ারি, ২০২০ থেকে XeonBD-এর সকল হোস্টিং প্ল্যান (Startup, Enterprise, Corporate, VPS, Dedicated Servers বা অন্যান্য) এর জন্য মাসিক ট্রাফিক লিমিট হিসাব করা হয় ইনকামিং এবং আউটগোয়িং ট্রাফিকের সমান ভাগে। মোট ট্রাফিকের অর্ধেক ইনকামিং এবং অর্ধেক আউটগোয়িং হিসাবে বরাদ্দ করা হয়। যদি ইনকামিং বা আউটগোয়িং ট্রাফিক বরাদ্দের চেয়ে বেশি হয়, তাহলে অতিরিক্ত MB/GB-এর জন্য নির্ধারিত হারে চার্জ করা হবে।
শেয়ার্ড হোস্টিং ট্রাফিক নীতিমালা:

শেয়ার করা ব্যান্ডউইথ পোর্টের ক্ষেত্রে (VPS, Dedicated Server বা FTP সার্ভারের জন্য) কোনো ন্যূনতম ব্যান্ডউইথ গ্যারান্টি দেওয়া হয় না। তবে, আপনি নির্ধারিত ব্যান্ডউইথ পোর্ট নিতে পারবেন। নির্ধারিত ব্যান্ডউইথের জন্য ৭৫% পর্যন্ত গ্যারান্টি দেওয়া হয় আন্তর্জাতিক সার্ভার এবং ১০০% IX সার্ভারের ক্ষেত্রে। নির্ধারিত ব্যান্ডউইথ পোর্টের মূল্য জানার জন্য XeonBD-এর সেলস টিমের সাথে যোগাযোগ করুন।
১৬) নির্ধারিত রক্ষণাবেক্ষণ এবং ডাউনটাইম:
XeonBD সারা বছর, সপ্তাহে ৭ দিন, দিনে ২৪ ঘণ্টা পরিষেবা দেওয়ার চেষ্টা করে। তবে, কিছু সময়ে রক্ষণাবেক্ষণ বা আপগ্রেডের জন্য সার্ভার অ্যাক্সেস অস্থায়ীভাবে বন্ধ থাকতে পারে (“Scheduled Downtime”)। এছাড়া, টেলিকমিউনিকেশন বা নেটওয়ার্ক সমস্যার কারণে কিছু সময় সেবা ব্যাহত হতে পারে যা XeonBD-এর নিয়ন্ত্রণের বাইরে।

XeonBD সর্বোচ্চ সিস্টেম নিরাপত্তা নিশ্চিত করার চেষ্টা করে। তবে, ডেটা হারানোর জন্য XeonBD কোনোভাবে দায়ী থাকবে না। আপনার গুরুত্বপূর্ণ তথ্য সবসময় নিজস্ব কম্পিউটারে নিয়মিত ব্যাকআপ রাখার পরামর্শ দেওয়া হয়।
শেয়ার্ড হোস্টিং ব্যাকআপ সুবিধা:
শুধুমাত্র শেয়ার্ড হোস্টিং গ্রাহকদের জন্য স্বয়ংক্রিয় রিমোট ব্যাকআপ (ফ্রি) অপশন রয়েছে, যা হার্ডওয়্যার বা সার্ভার সমস্যার সময় সর্বশেষ ব্যাকআপ থেকে পুনরুদ্ধারের জন্য ডিজাইন করা হয়েছে। তবে, ৫০ জিবির বেশি ডেটা থাকলে এই ব্যাকআপ কভার করা হয় না।

১৯) কার্যক্রম:
উপরের নীতিমালা লঙ্ঘন করলে আপনার অ্যাকাউন্ট নিষ্ক্রিয় করা হতে পারে। XeonBD নিজের সিদ্ধান্তে লঙ্ঘন চিহ্নিত করবে এবং সেই অনুযায়ী ব্যবস্থা নেবে।
